Terms and Conditions
- Term: The term of this agreement will commence on the creation of the account within the LOC8 system and will continue until one month written notice is given.
- Type of Support: Support of the LOC8 service will be via telephone and email only. If LOC8 is required to take on site support for any reason whatsoever, this will be charged at LOC8's standard rates which will include travel expenses.
- Core Support Times: Support is offered by LOC8 during regular business hours, Monday to Friday, 8:30am to 5:30pm inclusive except statutory holidays.
- Conditions: All charges in respect of the provision of the LOC8 service are due and payable in advance.
- Delays: In no event shall LOC8 be liable for any delay or incorrectly sent information either directly or indirectly to: (a) acts of the customer, it's agents, employees or subcontractors; and (b) causes beyond the control of LOC8 including but not limited to acts of God, acts of public enemy, acts of the Government, fire, floods, epidemics, quarantine restrictions, strikes, civil disorders, freight embargoes, any usually severe weather conditions or default of the company's subcontractors or suppliers.
- Entire Agreement: This agreement constitutes entire agreement between the parties hereto on the subject matter set forth herein. All propr agressments, whether written or verbal, shall be of no force or effect. Any statement, agreement, representation or other communication or expression not contained herein is without authorisation or and shall not be binding upon LOC8.
- Effective Date: The agreement shall become effective if and upon the date it is executed by an officer or duty authorised representative of LOC8 at its principal place of business.
- Termination: LOC8 may suspend this agreement immediately if it is the view of either LOC8 or the subsequent telecommunication carrier that the servce is being used indiscriminately for unsolicited marketing and/or contains offensive or illegal material; to any mobile user.
LOC8 may terminate this agreement if the customer is not capable of remedying the indiscriminant use; or the breach is capable of being remedied and the party in breach fails to remedy the breach within 10 working days after notice in writing has been given to the party in breach requiring such breach to be remedied; or where an insolvency event occurs in respect of the other parts.
- Warranty: LOC8 warrants that it is the owner or licensee of all intellectual and property rights in the services supplied to the customer. LOC8 hereby indemnifies the customer for all costs and expenses (including between solicitor and client), losses or claims whatsoever which the customer may incur or suffer in the event the foregoing warranty is breached. Such amount payable to the customer will be limited to the amount the customer has paid LOC8 for services for the immediate month prior to any claim being lodged by the customer.
- Refunds and Dispute Resolution: In the event of a dispute or belief that a refund is due, the customer will submit the applicable request in writing, including all facts, dates and possible amounts, to LOC8 before any dispute or refund request will be considered.
- Prices: All prices are shown in New Zealand dollars. Goods and Services Tax (GST) is charge at it's current rate of 12.5%
